Terms and conditions for purchase with Vital Health Europe

GENERAL CONDITIONS


The agreement applies to the relationship between you as a customer (CUSTOMER) and Sunn og Frisk AS

BY PLACING A CHECK MARK IN THE "I ACCEPT THE TERMS AND CONDITIONS" CHECKBOX OR OTHERWISE USING THE Sunn og Frisk AS WEBSITE, YOU AGREE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT AND AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT.

If you agree, place a check mark in the "I accept the Terms and Conditions" checkbox during the checkout process. If you place a check mark in the "I accept the Terms and Conditions" checkbox without actually reading this agreement, you will nevertheless be legally bound. If you do not agree to be bound by the terms of this Agreement, do not place a check mark in the "I accept the Terms and Conditions" checkbox. If you do not place a check mark in the "I accept the Terms and Conditions" checkbox you will not be able to purchase goods from the site or proceed with the registration process to become a subscriber.

 

Sunn og Frisk AS:

* Personal information: Any information stored in the Sunn og Frisk AS membership database will only be used internally. Sunn og Frisk AS will not disclose information to other parties. Information stored at the conclusion of the subscription. Sunn og Frisk AS is responsible for the management of personal information.

* Reserves the right to close down the website www.vitalhealthuerope.com and / or its online store due to unforeseen disruptions in operations outside Sunn og Frisk AS's control.

* Reserve the right to make reasonable changes to the offer based on seasonality, market competition and other business matters.

* Reserve the right to limit the number of subscriptions.

* Disclaim any responsibility for any loss or damage to persons resulting from the use and / or abuse of Sunn og Frisk AS products or information provided or distributed by Sunn og Frisk AS. Sunn og Frisk AS will be liable by their own negligence in relation to product content.

*Have the right to assign this contract to third party.

 

CUSTOMER:

* Is responsible to check that Sunn og Frisk AS products are appropriate for their health and conditions or medications being taken.

* If signed up to a personal subscription purchase agreement with Sunn og Frisk AS they understand that can not be transferred to another party without the consent of Sunn og Frisk AS

* Understands and agrees that no information on www.vitalhealthuerope.com, or other information received or published by Sunn og Frisk AS, are intended to be or should be construed as medical diagnosis or treatment. Information provided is not a substitute for medical advice and is intended to be for general information only.

* Must ensure the nominated credit card it active. If a card is stolen, it is the customer's responsibility to contact us to update card details.

* Accepts that this agreement can be terminated if the online store must be shut down due to unforeseeable disruption in operations.

* Is obliged to notify if there is a change of address. Sunn og Frisk AS can not be held responsible for any product lost or stolen in the event of failure to update address details.

 

SINGLE PURCHASE CONDITIONS

 

1. AUTOMATIC CREDIT / DEBIT CARD / PAYPAL PAYMENT METHOD AGREEMENT

Payment is made at the time of ordering by Credit Card or PayPal account.

2. PAYMENT FAILURE

If a payment is declined, goods will not be shipped until the customer provides corrections to payment information and a successful payment transaction is completed.

3. PRICE ADJUSTMENT

Sunn og Frisk AS reserves the right, without prior notice, to regulate the product price corresponding to the increase in the consumer price index.

4. 100% SATISFACTION GUARANTEE

The customer may take advantage of our 100% satisfaction Guarantee within 30 days of the first purchase of Vital Greens. Product will be supplied to the specified address. If the customer is not satisfied with the product for any reason it can be returned without obligation to Sunn og Frisk AS The Satisfaction Guarantee only covers the trial of one pot of product - if multiple pots of the same product are purchased, the refund only covers one 'open/used' pot.  All other product must be returned with the seal intact and in saleable condition for a refund on those items. All product containers (whether sealed/full, partly used or empty) must be returned in order to receive a refund. 

A Return Note Authorisation request form must be completed by the customer within 30 days of the invoice date along with a written explanation of the reason for the return. Once an RNA number has been issued to the customer, the goods must reach the warehouse within 14 days clearly labelled with the RNA number.

Sunn og Frisk AS will then refund the purchase amount in part or full, as applicable within 30 days of receipt of goods to the warehouse. All costs associated with the return of product are carried by the customer.

5. PROCEDURE FOR SHIPPING OF GOODS

For general sale, goods are shipped within 1-3 working day from date of the order.

If the package is not delivered successfully after 2 attempts, it will be returned to the depot. A re-shipping fee will apply to resend the goods once they have returned to the depot. A re-shipping fee will apply if goods are returned due to incorrect or incomplete address details being supplied on the website by the customer. If the customer receives a packet that is not in accordance with the agreement and the package is returned, the customer will not be charged for this.

6. CURRENCY CONVERSION FEES

Currency conversion fees may apply in orders placed on the website in currency other than Euro.

 

SUBSCRIPTION CONDITIONS

 

1. AUTOMATIC CREDIT / DEBIT CARD / PAYPAL PAYMENT METHOD AGREEMENT

By accepting this Agreement, Subscriber authorizes an automatic recurring payment to Provider from the Subscriber's credit, debit, bank card or PayPal account (the "Automatic Recurring Payment Method") for the duration of the contract period.  For non-binding and 4 or 12 month contracts, payment will be deducted from the nominated credit card every 2 months, 3 days prior to the goods being are shipped.

The subscription provides two months worth of product every two months.  For 4 and 12 month contracts, the price is guaranteed throughout the binding period and payment for a subscription cannot be stopped prior to the completion of the binding period.  At the end of a binding period, the contract rolls over to an ongoing subscription. The shipping of product will continue until the subscription is cancelled.  Notice to cancel a 4 or 12 MONTH subscription must be received at least 30 days before the next scheduled delivery date.  Notice to cancel a non-binding subscription must be received at least 7 days before the next next payment is due.  The delivery of goods and card payments continue until either party terminates the contract.

2. AUTOMATIC RECURRING PAYMENT FAILURE

If a payment demand on Subscriber's Automatic Recurring Payment Method is declined, goods will not be shipped until the customer provides corrections to payment information and a successful payment transaction is completed.

The 4, and 12 month contracts are binding for the full duration of the contract period regardless of payment failures.  Sunn og Frisk AS will provide adequate opportunity for the customer to correct payment details. In the case of material breach of payment (two or more simultaneous denied credit card transaction requests) Sunn og Frisk AS are within their right to pursue payment for the remainder of the outstanding contract value via a debt collection agency.

3. PRICE ADJUSTMENT

Sunn og Frisk AS reserves the right, without prior notice, to regulate the product price corresponding to the increase in the consumer price index.

The 4 and 12 month subscriptions come with a price guarantee - see 4. PRICE GUARANTEE.

4. PRICE GUARANTEE

The 4 and 12 month subscriptions come with a price guarantee.  Once the binding period has completed, the rolling monthly contract commences.  At this point, the price guarantee no longer applies.  If wishing to guarantee the price for a further fixed period, the customer must sign up to another 4 or 12 month binding contract.

6. PROCEDURE FOR SHIPPING OF GOODS

For all subscription orders, shipment of goods will take place 1-2 days after the 'First Delivery Date' customer specifies during the order process. Shipment of goods will only take place once payment has been confirmed.  Each subsequent shipment, product will be sent at two monthly intervals at the same time of the month as the initial subscription date. Payments will be deducted from the nominated credit card or PayPal account at this time.

A re-shipping fee will apply if goods are returned due to incorrect or incomplete address details being supplied on the website by the customer. If the customer receives a packet that is not in accordance with the agreement and the package is returned, the customer will not be charged for this.

a. CHANGE OF ADDRESS: can be done online by the customer but must be submitted 10 days prior to the next scheduled delivery date.  Changing the delivery address after this date may incur additional delivery charge if the goods have already left the warehouse.

7. PUTTING A SUBSCRIPTION 'ON HOLD'

The following reasons apply: a) Sickness or ill health for a continuous period of at least 1 month. (Note that Vital Greens is generally supportive to healing. This clause applies if continued use is not recommended by a physician or qualified personnel in conjunction with medication or other cause). b) Pregnancy c) Temporary stationing in the context of work / study / military service that is beyond their own borders. Subscription cannot be put on hold due to holidays. 

A hold period can be for a minimum of 1 month and a maximum of 12 months.  'Hold time' does not contribute towards the agreed 4 or 12 month contract period. The period of exemption of payment may differ from the Hold period, but is valid for as many months. A request to put a subscription on hold cannot be made retrospectively. Documentation of medical certificate, a certificate from a doctor / clinic, confirmation from the employer / school must accompany the application for the Subscription Hold and be specified with the 'from date' and 'to date'.  An expired medical certificate is not acceptable. Sunn og Frisk AS must approve a subscription Hold request before the Hold period commences and payments adjusted.

8. CONTRACT 'PAUSE'

The 4 or 12 month subscription comes with the right to pause the subscription for two calendar months (i.e one delivery) during each 12 month period for any reason. Payment period is extended with the Pause period so that the full 4 or 12 months contract is still applicable.  Unused 'Pause' period cannot be transferred to the next calendar year.  This provides subscribers the flexibility to go on holidays or take a break from delivery for any reason without losing their favourable subscription rates.

9. TERMINATION OF SUBSCRIPTION

4 or 12 month contracts expire in the calendar month which comes after the termination month on the date which corresponds to the initial contract signup date. (Example: a 12 month subscription is registered on 15th November 2012.  The subscription expires on 15th December 2013, with final shipment and payment taken on 15th October 2013). When the binding contract term ends, product will continue to be shipped and payments deducted every two months until either party terminates the contract. Cancellation of a rolling contract must be made by the customer at least 30 days before the next payment is due. If the customer wants to terminate the contract at the end of a fixed contract period, the termination request must be made by the customer at least 30 days before the end of the fixed contract period.   Termination of subscription must be made in writing on the website. Confirmation of termination will be provided by Sunn og Frisk AS by email.

For non-binding subscriptions, cancellation must be made by the customer at least 7 days before the next next payment is due.

10. BREAKOUT CLAUSE

If the customer wishes to terminate a subscription after the initial 30 day trial period, they can do so by paying out the contract.  The payout amount depends upon the number of items received and the subscription being terminated.  The breakout fee equals the difference between the subscription price and the RRP of the products shipped thus far.

11. SPECIAL CONDITIONS

Before a 4 or 12 month contract period has ended, the subscriber may, by due to extenuating circumstances propose that it is no longer possible to complete the contract period, ie if the subscriber is unable to consume Sunn og Frisk AS products for reasons such as an allergic reaction or intolerance and need to terminate before the agreed 12 month period. These requests must be made via the online form and backed up by official documentation to support the extenuating circumstances (e.g letter from healthcare professional, relocation job offer, etc).

12. Subscriptions are not available in conjunction with any other discounts or offers.

Currency conversion fees may apply in orders placed on the website in currency other than Euro.
